I still think they look like cockerels, their combs and wattles look quite prominent.
Leghorn cockerels and hens have large combs and mature very quickly, but even on the hens they are hardly noticable at that age.
I may be wrong, but first impressions.
Did he say they are definatley hens?
Does he sell a lot of chickens?
Give him a ring and ask him what breed they are, and express your concerns.

Good Luck

hi he said they were def all hens, i asked him twice and told him why i had to havehens and he assured me they were all hens, ive not phoned him yet, as i wanted some advice on what other people think they  could be, and id have to be almost certian they were cockrels, as i didnt want to go mad at him if they were hens. think hes quite a big breeder said he had 2 farms, he might hang up on me, as if they are cocks then he def would have known.  just want to get as many veiws as poss before i try phoning him

i think they are hens, unless you can find someone to sex them for definate your only option is to wait and see, after all if they are cockerals they will still be cockerals in a few weeks time and the seller should still take them back.

Best to wait until someone recognises the breed to give you their thoughts.  :)
If he is a big breeder then realy he should be telling you the truth as otherwise word of mouth will lose him a lot of business.  ???

If they are Welsummers, which they do look like, they are boys. They are too dark to be girls. Thats only my opinion though! Give them a couple of weeks and you will be sure. :)

I would say 99% sure they are cockerels, but don't take my word for it.

I will try to get a good picture of my welsummer tomorrow and not too sure these are welsummers, can you not ask the breeder what breed they are. I can't tell what sex they are? I hope they are girls but you will soon find out.

I've got no idea never had a cockerel, but don't forget even animals are covered by the sale of goods act they must be "fit for purpose" so if they are then they are obviously not fit for purpose.
Does not help you much, but you should at least be able to take them back and get hens
He who asks is a fool for five minutes, but he who does not ask remains a fool forever.

If they are Welsummers I would say 100% cockerel, they are very much like Marans. In this photo the chick on the middle left is a Maran cockerel and the two on the front left are Maran hens, they are also about 8 weeks old.

wow there is a lot of difference in their combs on the marans. Just hatched 5 copper blue marans (on Monday) so will have to keep a check on their combs to see how many are girlies. At what age will I be able to tell?

You should be able to tell at about 2 weeks, but sometimes it is not always that obvious.
