Appeal against eviction
« on: December 10, 2021, 19:10 »
Hi all,

Here’s the latest in my eviction saga. After today’s developments I would like to name and shame, but am not sure the admins would allow it.

Both the National Allotment Society and my local allotment federation have been very supportive of my case. The NAS is clear that my eviction is illegal and that I’m entitled to a fully independent appeal chaired by one of their regional reps.

My allotment committee, however, said they would only agree to this if they could still evict me at the end of it, whatever the outcome (!)

I’ve spent the last four months, with help from the NAS and my local federation, trying to engage my committee in mediation, but they have consistently refused to take part. They refused me any right of appeal or reply until yesterday, when they suddenly announced I had 24 hours until this evening to submit my evidence in writing to the trustees, via a third-party address, which was impossible. The appeal is being orchestrated by the same person who engineered my eviction, and I am not being allowed to speak to the trustees direct. I am told I will then receive a response (and guess what that will be!) via the secretary in writing. They had threatened to dispose of my hundreds of pounds worth of property this weekend, and my guess is that’s still what they plan to do.

The worst thing of all is that my local council - who have refused throughout to take any responsibility as it’s a self-managed site - have fully supported this action since yesterday, and don’t seem to see anything undemocratic about it at all. I am absolutely dismayed. Interventions from my local councillor and appeals to the chief exec of the council have made no difference.

Really, I’m utterly distraught.
I don't really look like my avatar.

They may be! :)

If you think they might be interested act NOW.  Don't wait, strike while the iron is hot.

In the meantime, organize whatever vehicles and personnel you need to move your personal property off the plot.  Unless you prefer that it wind up at the local tip.  Again, do  not  wait !!!

what was the response of the little hitler who's orchestrating this to your threat of legal action?

Perris, I’ve had no response as yet. I haven’t yet sent a formal legal letter as I didn’t want to do so until I was ready to follow through with it - I am now.

The local council is a disgrace, supporting these mini nazis’ behaviour.

Understood, Aunty. But true, I’m afraid. On a really serious note, I can well understand how extremists come to power when you encounter people like this. x

I echo MB as not only should it bring this to the general public's attention but may also help any others in a similar position. GO FOR IT!!!!
I work very hard so don't expect me to think as well.

Hello just wondering how you have got on with your allotment, I've been chatting to some one today who was an allotment officer on his parish council , I asked him if some one could be evicted at the allotment committees  whim he said absolutely not, the allotment committee should have a contract with the local council out lining their terms and conditions if the said committee cannot show this contract they are not fit for purpose (not the exact words used I kept it clean)   the committee must when requested show the contract between  them and the council and if theres any eviction policy it must be available  on request    jezza
