Title: Laws on pasture land
Post by: Earthmary on February 04, 2011, 15:38
I have just purchased a plot of pasture land 18 x 56 m and I would like to turn it into an allotment.  Im unsure of the laws and planning permission on this, can anyone advise me please before i dive in and build a fence and dig it up.

Thanks in advance

Welcome Earthmary,

Apologies if I'm going to sound like a numpty but if you've just purchased a small parcel of land and you now wish to cultivate it, presumably this was your intention at the time of purchase. If you used expensive professionals to facilitate things. Is this not the sort of question that you've alrady paid to have answered?

You do not need any planning permission to turn agricultural land into allotments.

I think there may be laws stopping you changing pasture land into a decorative flower garden - unless you were growing flowers for resale in which case I suppose they become a crop.

I think there are also laws preventing you turning the land into a garden related to a dwelling, irrespective of usage.

But as Aunt Sally says, mere use as allotments should remain agricultural and therefore OK.  You'll probably need planning permission if you want to erect any new buildings though.

I thought it was allowed to put structures related to on agricultural land? Probably far more complex than I thought.

there is also supposed to be a bi law somewhere that allows for dwelling to be built on pastured one they have been used for a certain amount of years.

I suspect you know more about this than I do!  It is a complex area, for sure

I'd be very surprised if new dwellings (i.e. not replacing an existing one) were allowed without planning permission, and councils are increasingly scrutinising such applications closely.

But this is very different to the original question!

Flowers for just you are a no-no (had a friend change his field to a rose garden and had to plough the lot up) but as for putting agricultural buildings on it you may have to have building regs as opposed to planning permission. A quick chat with your local planning department will let you know (they can be very helpfull).
As for putting dwellings up - this was a very much over used loop hole and they have now tightened up on this - lots of people used to get a handfull of chickens or a couple of goats or horses, wait a couple of years, build a house then get rid of the animals.
