Can I cut down diseased tree

Hi all,can anyone tell me is it ok to cut down a diseased tree without prosecution ,its in my daughters back garden,its about 20 ft high ornamental (not sure of variety) the bark is coming off and has almost no leaves almost dead.Cheers

Your local council can tell you if it is protected.  It should have been made clear when the property was purchased, too, but to be on the safe side, check with the council.

if it has a protection order then no
if she rents the place, then landlord does it
if neither of these cut down and use wood on log burner or instead of massive fire in garden,freecycle the wood
